While we strive to provide reliable service, we cannot guarantee:

  • 100% uptime or uninterrupted access
  • Compatibility with all devices or browsers
  • That alarms will always trigger in all circumstances
  • Protection against all technical failures or internet outages

The Service depends on your device's capabilities, browser settings, and internet connection. We recommend testing the alarm functionality before relying on it for critical wake-up times.

5. Privacy and Data

Your privacy is important to us. Our data collection and use practices are described in our Privacy Policy, which is incorporated into these Terms by reference.

By using the Service, you acknowledge that alarm data is stored locally on your device and that we collect minimal technical information as outlined in our Privacy Policy.

6. Intellectual Property

The Service and its original content, features, and functionality are owned by Set an Alarm and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

You may not copy, modify, distribute, sell, or lease any part of our Service, nor may you reverse engineer or attempt to extract the source code of our Service.

No Warranty

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

Reliability

While we strive for reliability, we cannot guarantee that alarms will always function perfectly due to factors beyond our control, including but not limited to:

  • Browser crashes or updates
  • Device power management settings
  • Internet connectivity issues
  • Operating system limitations
  • Hardware malfunctions

8. Limitation of Liability

IN NO EVENT SHALL SET AN ALARM BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR USE OF THE SERVICE.

This includes, but is not limited to, damages that may result from missed alarms, late arrivals, missed appointments, or any other consequences of alarm failures.

9. Indemnification

You agree to defend, indemnify, and hold harmless Set an Alarm from and against any claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including but not limited to attorney's fees) arising from your use of the Service or violation of these Terms.

10. Termination

We may terminate or suspend your access immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

Upon termination, your right to use the Service will cease immediately. Since no personal accounts are created, termination simply means blocking access from your IP address or device.

11. Governing Law

These Terms shall be interpreted and governed by the laws of the jurisdiction where our service is operated, without regard to its conflict of law provisions. Any disputes shall be resolved in the courts of that jurisdiction.

12. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days notice prior to any new terms taking effect.

What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.

13. Severability

If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect. These Terms constitute the entire agreement between us regarding our Service.
